Quebec seeks court of appeal ruling on constitutionality of C-92

The Minister of Justice and Attorney General of Quebec, Sonia LeBel, will ask the Quebec Court of Appeal for a decision on the constitutionality of the Act concerning First Nations, Inuit and Metis children, youth and families on the grounds that it “exceeds the power of the Parliament of Canada under the Canadian Constitution.”

Quebec believes the law, adopted June 21 of this year, “constitutes an appropriation of the exclusive jurisdiction of the provinces in matters of social services and youth protection.”

Quebec also claims the enforcement date of the law in January “risks causing serious difficulties with regard to the Organization of health and social services” in the province, particularly in regard to youth protection.
